A new Provisional Criminal Code and Provisional Criminal Procedure Code entered into force on 6 April 2004. Article 192 provides definitions for consent and sexual acts. "Consent is defined as the voluntary agreement by a person of at least sixteen years of age to participate in a sexual act (Article 192(1)). "Sexual act" is broadly defined as the "penetration of any part of the body of a person with a sexual organ, or the penetration of the anal or genital opening of a person with any object or any other part of the body" (Article 192(3)).
Regulation No. 2003/12 on protection against domestic violence (PDF, 17 pages) entered into force on 9 May 2003. This protects an individual from specified forms of violence, including: infliction of bodily injury; non-consensual sexual acts or sexual exploitation; causing fear for physical, emotional or economic well-being; kidnapping; causing damage to property; unlawfully restricting freedom of movement; forced entry onto the property of the other person; forced removal of the other person from a common habitation; prohibiting the other person from entering or leaving a common residence; engaging in a pattern of conduct to degrade the other person. The Regulation protects a person who is engaged, married, or cohabitating with the perpetrator, who shares a household with and is related to the perpetrator by blood, marriage, adoption, or guardianship, or who has a child in common with the perpetrator. Chapter 2 provides for protection orders, emergency protection orders and interim emergency protection orders; Chapter 3 addresses the role of law enforcement, and; Chapter addresses the prosecution of violations of protection orders and the crime of light bodily injury.
On 10 December 2003, UNMIK published a set of standards (Albanian) (Serbian) to facilitate Kosovo's progress to final status. These standards focus on eight areas: functioning democratic institutions, the rule of law, freedom of movement, sustainable returns and the rights of communities and community members, economy, property rights, dialogue, and the Kosovo Protection Corps. The "Equal Access to Justice" section under the rule of law requires "effective action to eliminate violence against women and children, trafficking and other forms of exploitation, including preventative education and provision of legal and social services to victims."
