A 2006 law on Prevention and Combating Trafficking in Persons criminalizes sex and labor trafficking, and determines sentences similar in length and severity to other grave crimes, such as rape. However, this law is still not sufficiently enforced. NGOs argue that this is due to law enforcement corruption and complacency.
In 2003, the Kyrgyz government passed a law on domestic violence. The law provides definitions for domestic violence, physical domestic violence, psychological family abuse and sexual violence. Article 6 outlines the rights of the victims of domestic violence, which include the right to orders for protection where needed. It also sets forth the responsibilities of law enforcement, prosecutors, courts, state institutions and NGOs. Again, enforcement of the law is the biggest challenge to its successful implementation.
A draft law on gender equality was written in 2003, but as of 2009, it has not been ratified. The draft law defines direct and indirect discrimination, equal opportunities, equal rights, equal responsibility, gender equality and gender equity. It provides for equality in several areas, including property, social security, job choice, wages and social benefits.
