Restraining Order Entered into Force on 1 July 2006 7/24/2006 7:47 AMAs of July 1, 2006 restraining, as a new legal instrument became part of the Hungarian law. The provisions on restraining order were introduced into the Hungarian legal system as part of the law on criminal procedure.
According to this law any person can apply for a restrictive order who needs protection during the course of a criminal procedure, i.e. who has either reported a crime to the police, or who suffered an assault where an ex officio criminal procedure was started against the assailant (this latter is applicable in cases of serious bodily harm). Restriction may last from 10 to a maximum of 30 days and is issued by the criminal judge who is responsible for the criminal procedure. There is no legal possibility for the prolongation of the order for restriction.
