  • The Committee expressed appreciation to the Ukraine Government for submitting the report on time; however, it noted that it did not follow the general guidelines regarding the form and content. The report set forth general principles and no information on practical implementation or measures taken. The Committee found that under the circumstances and changes in Ukraine, it was impossible to determine how the Convention was implemented. The Committee noted it would like to know what measures are being taken to incorporate the provisions of the Convention that are not already part of national law and whether the Convention could be invoked before a court. The Committee requested that the next report include, in detail, planned and completed implementation measures and appropriate legislative texts.

  • The Committee praised the Ukraine Government for the adoption article 28 of its Constitution, which prohibits torture; for joining the Council of Europe and signing the European Convention on Human Rights and 11 protocols to that Convention; the legislative incorporation of provisions ensuring respect by law enforcement personnel for human rights and freedoms and on the obligation to comply with them. The Committee recommended that the Ukraine Government draft and adopt directly enforceable regulatory instruments, with priority given to on the adoption of a new criminal code that defines torture as a punishable offence and a new code of criminal procedure that guarantees the right of an accused person to counsel at all stages of criminal proceedings. The Committee expressed concern over reports by NGOs of torture and violence committed by officials during preliminary investigations, the lack of a sufficiently effective system of independent bodies capable of investigating complaints and allegations of torture, and the scale on which the death penalty is applied.

  • The Committee expressed appreciation for the Ukraine legislative reform including the adoption of a new Criminal Code containing an article qualifying torture as a specific crime, the establishment of a new Constitutional Court, the enactment of new legislation relating to the protection of human rights and the adoption of a new Law on Immigration.  The Committee also praised the Ukraine for abolishing the death penalty and the establishment of the Office of the Commissioner for Human Rights.  The Committee expressed concern about reports indicating that torture is still regularly practiced, the duration of pre-trial detention, and the lack of adequate training of police and prison personnel on their duties under the law and on the rights of detainees.  Among the Committee’s numerous recommendations were to establish a fully independent complaints mechanism to ensure prompt, independent and full investigations into allegations of torture; improve conditions in prisons and pre-trial detention centers; and take effective measures to prevent and punish trafficking of women and other forms of violence against women.
