- The Committee noted the State Party's measures taken to counter human rights violations, including steps to ensure that arrests and detentions are carried out by legal authorities and not by uncontrolled individuals, the delineation of legal responsibility between the military and civilian police, the replacement of authorities who have committed violations and the dismantling of groups which have been responsible for violations. The Committee expressed its concern at the high number of killings, arbitrary arrests, detentions, the private operations of prisons and the mistreatment of persons. The Committee recommended that Bosnia and Herzegovina intensify measures to prevent acts of ethnic cleansing, ensure that all places of detention are officially proclaimed, maintain and make public records of all detainees, open all places of detention to the International Committee of the Red Cross and the families of detainees, and shut down all places of detention that do not comply with these conditions.

The Committee notes with appreciation and welcomed the adoption of new laws, state action plans and the establishment of state institutions and mechanisms related to the monitoring and protection of various specific human rights (such as gender equality mechanisms, the law on domestic violence, the law on witness protection etc.) However, the Committee expressed concern regarding the implementation of the laws and effectiveness of state institutions and mechanisms, as well the practical impact of State Action Plans. One of the recommendations clearly underlines the necessity of the implementation of the Gender Equality Law, namely the harmonization of other laws with this law. Further, the implementation of the legislation regarding domestic violence is connected to imperative intensive training for judges, prosecutors and law enforcement officers, as well as for health and other professionals working with victims of domestic violence and child abuse.
