The need for development of this manual occurred after the Montenegrin legislation was amended during 2004, including the Criminal Code, Law on legal procedure and Law on executive procedure. The new laws contain many innovations and amendments in regard to the previous legal regulations, due to the need of state prosecutors to implement new legal solutions in their practical work in developing complete acts from state prosecutors’ competency.

Supreme State Prosecutor of the Republic of Montenegro, Ms. Vesna Medenica, was the initiator for the development of this Manual through the Association of Montenegrin State Prosecutors. The Association made an agreement/contract with FOSI – ROM as the donor of this project and formed a working group in charge for manual’s development: 

• Ms. Zagorka Popovic, Deputy Supreme State Prosecutor of the Republic of Montenegro, 
• Mr. Petar Kapuci, Deputy Supreme State Prosecutor of the Republic of Montenegro, 
• Mr. Veselin Vuckovic, Basic State Prosecutor in Podgorica, 
• Ms. Radmila Cukovic, Counselor of the Supreme State Prosecutor of the Republic of Montenegro, and 
• Mr. Mitar Mugosa, Deputy of the Higher State Prosecutor in Podgorica and the President of the Association of State Prosecutors – coordinator of the working group.

The aim of this manual is to avoid misinterpretations of certain legal regulations which can occur in everyday practice, and, especially, equalization of the state-prosecutor’s practice. Therefore, the working group is of the opinion that the Manual will contribute to easier usage of legal texts, as well as to more quality work of the state prosecutors.

The working group in the Manual provides just the general and legal directions for state prosecutors, without any intention to influence their creativity in the process of development of certain legal acts.
