The U.S. Attorney General has overturned the Board of Immigration Appeal’s decision that recognized domestic violence victims’ ability to qualify for asylum. The Attorney General’s decision focused on whether a victim of domestic violence could prove that she was persecuted as a member of a “particular social group.”
The decision also stated that “[g]enerally, claims by aliens pertaining to domestic violence or gang violence perpetrated by non-governmental actors will not qualify for asylum.”
