Case summary:
D.D is a Guatemalan national who endured years of severe sexual and physical assault (approximately 2005–2016) by a police officer, with additional abuse by family members who facilitated assault. The officer repeatedly threatened to kill him if the persecution was reported. In 2016, after D.D confided in a friend who reported the abuse, the friend was found dead. The officer then directly threatened D.D, stating they would suffer the same fate.
Despite relocating within Guatemala, the officer continued to track, harass, and threaten the D.D and their family. The abuse occurred in a context of widespread homophobia and police impunity, leaving D.D without protection.
Fearing for their life, D.D fled Guatemala. During transit through Mexico, D.D was kidnapped, assaulted, and robbed. Upon arrival in the United States, D.D was detained for approximately one month and was paroled into the U.S. after establishing credible fear of persecution on account of a protected ground.
Theory of the Case: Fear of future persecution by government actors on account of based on membership in particular social group-LGBTQ+1 (and related fomulations), likelihood of torture by policeman acting under color of law.
Commitment: Represent client through the remainder of removal proceedings, preparing and filing additional evidence, pre-hearing brief, and preparing the client for a final merits hearing. Asylum Application has already been filed.
